1. Terms of use were established on the basis of the following Polish legal acts:

2. Terms of use are made available free of charge, to familiarize or fixation and print.

3. Please read these Terms of use very carefully. By using our main website: and subsites, ordering goods from our e-Shop PREDATOR-FISHING, using our services you agree to the Terms of use as shown below and agree to be bound by them.

4. Definitions:

 - The e-Shop offer - goods listed and described on the tabs on the website e-Shop. Seller constantly due diligence to e-Shop offer was correct, current and consistent with the facts.

 - The Product – the e-Shop offer with the associated services including delivery.

 - The contract of sale – distance selling contract between Seller and Client.

 - The account "Moje konto" - a virtual space available after the registration process, enabling data management by the Client. He can have one account only.

 - The Order - Client's statement specifying the number of products that aim to the conclusion of the contract of sale.

5. Terms of use have been put in place to protect the interests of our Clients and provide the best service possible. Regulations are designed to be fair and clear to both Seller and Clients.

6. Any provision of the Terms of use of limiting the power of the Client as a consumer are null and void. If any provision of these Terms of Use is, or is found to be, unenforceable under Polish law, that will not affect the enforceability of the other provisions of these Terms of Use.

7. Seller reserves the right to: revise, update, change, modify, add to, supplement, or delete certain parts of the Terms of use at any time and in any way, provided, however, that material changes will not be applied retroactively. Such changes will be effective upon acceptance. If any future changes are unacceptable to you or cause you to no longer be in agreement or compliance with Terms of use, just report this to Seller. You are responsible for checking Terms of use periodically for changes.

8. Client agrees not to use e-Shop and any content contained in it for any illegal, unlawful, fraudulent, harmful or inappropriate activities unconditionally.

9. Unless stated otherwise Sellerowns the intellectual property rights in The website e-Shop, including content, materials, and graphical elements. Subject to the license below, all these intellectual property rights are reserved.

10. Terms of use are subject to the applicable Polish law and the proper jurisdiction of the Polish common courts.

11. The Seller does not allow to:

 - republish any material from the e-Shop,

 - sell, rent or sub-license any material from the e-Shop;

 - reproduce, duplicate, copy or otherwise exploit any material from the e-Shop for any commercial purpose,

 - edit or otherwise modify or redistribute any material from the e-Shop for any commercial purpose.

12. Registration here is free and voluntary.

13. Registration is not necessary for making any purchases here.

14. When you register you must provide: full name, address, e-mail (login), phone number and set the password. Please be admonished that you must supply accurate, correct, non-misleading and complete data to register here.

15. Client may choose the account for: natural person or legal person.

16. Client may terminate his/her account together with the registration data at any time.

17. For the safety reasons, you should not give anyone your e-mail and password and always log off when you finish using the Service.

18. Upon registering Client declares that he/she has read, accepted these Terms of use and agrees to be bound by them.

19. During registration, Client may give voluntary consent to the placement of personal data in the database for processing in connection with the execution of orders or to receive commercial information in the form of a newsletter. Customer who has consented to have the rights set out in the Ustawa z dnia 29 sierpnia 1997 r. o ochronie danych osobowych. (Dz.U.1997, nr 133, poz. 883 z późn. zm.).

20. This e-Shop enables Clients to buy fishing accessories.

21. The offer e-Shop includes goods new only and free from defects in natural and legal legally marketed.

22. By submitting the Order Client submits a legally binding offer to conclude a sales agreement with the Seller.

23. All payments here are in advance.

24. e-Store accepts payments through:

 - PayU,

 - bank transfer,

 - cash,

 - popular credit cards via PayPal or PayU,

26. The prices here are in PLN and can be converted into the currency choosen by the Client according to the current exchange rate of the National Bank of Poland. All given prices are gross prices. e-Shop paid not apply additional options.

27. Seller delivers Orders through: Polish Post or carrier selected to the address provided by the Client. Delivery pricing can be found here:

28. It is possible to pick up in person on the premises of the Seller.

29. Sellers delivers worldwide.

30. The e-Shop offer have the manufacturer's warranty, as described in the attached documents.

31. Seller guarantees that our staff will use due professional care to provide the best services available.

32. Seller reserves the right to conduct marketing activities on the website e-Shop.

33. If the Seller and the Client has not had agreed otherwise, Seller shall execute the contract concluded at a distance no later than thirty days after the deposit by the Client declaration of intent to contract.

34. A Client who has a contract with the Seller at a distance, has the right to withdraw from the contract without giving any reasons for making a statement - within fourteen days. To comply with this deadline, you will be sent a statement before its expiry. Deadline fourteen, in which you can withdraw from the contract shall be counted from the date of issue of things, and where the contract involves the provision of services - from the date of its conclusion. The cost of return shall be borne by the Seller.

35. The right to withdraw from the contract applies only to the consumer sales, which applies only to the sale of a natural person who is purchasing for purposes unrelated to the activities of professional or business and does not apply to services, the supply of which commenced with the consent of the customer.

36. In case of an effective withdrawal, it is considered null and void, and the Client is released from any obligations. This is what the parties testified, is returned unchanged unless a change was necessary in the ordinary course of business. Recovery shall be effected without delay and not later than fourteen days. If the Client has made any advance payments are due from them statutory interest from the date of prepayment.

37. If you withdraw from a distance contract the Client shall only be liable for any diminished value of the goods resulting from the handling of the goods other than necessary to establish the nature, characteristics and functioning of the goods.

39. Within two working days of receipt of return the Seller will check the Product. Seller will refund the amount covering all amounts paid by the Client in connection with the contract of sale, regardless of the basis of their payment, at customer's bank account or money.

40. All Clients have the right to file complaints regarding the e-Shop offer using a warranty or guarantee. Complaints are dealt with fairly and discreetly within fourteen days. Possible complaints must be submitted in writing to the Seller or the Seller by e-mail in the form of a scan or photo of the letter. The complaint should include: the name or business name and address of the Claimant, the scope of the complaint, the details of the complaint, the signature of the Claimant.

41. The Seller does not have to pay the full purchase price or lower the price of goods only if will immediately exchange or repair.

42. In the case of non-compliance with the contract of sale the Client should send a letter indicating the nature and extent of non-compliance and client expectations regarding how to implement the obligations of the Seller, at its own expense to the address specified in the Terms of use.

43. Right to withdraw from the contract of sale or exchange, repair, reduce the price of the defective product or refund of the price are fundamental customer receiving the goods from the natural or legal disadvantage. Time for reporting defects in the goods is two years from its receipt.

44. The period of the presumption of a defect in a poorly made commodity is one year. The Seller is required to prove to the Client that the fault is due to his fault, for example from improper use.

45. In the event of a sale that is not a consumer sale, excludes the provisions of the 556-576 Ustawy z dnia 23 kwietnia 1964r. Kodeks cywilny (Dz.U.1964 nr 16 poz.93 z póź

46. The Seller shall not be liable for the disruption to the operation of the e-Shop caused by force majeure, failure of equipment or unlawful interference of the users.

47. The Seller shall not be liable for any failure to perform its obligations where such failure is as a result of Acts of Nature (including fire, flood, earthquake, storm, hurricane or other natural disaster), war, invasion, act of foreign enemies, hostilities (whether war is declared or not), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalisation, government sanction, blockage, embargo, labour dispute, strike, lockout or interruption or failure of electricity or telephone service.

48. The Seller shall not be liable for the hacking to the system and electronic mail used by the user, takeover of the login or password by a third party and infection the user’s computer system.

49. The Seller shall not be liable for the malfunction of the PayPal and PayU payment systems.

50. The Seller reserves the rights to temporarily or permanently disable the e-Shop, discontinue its management, interruptions in order to carry out the maintenance of the system to enable a proper functioning of the e-Shop not without prior notice to the Clients.

51. The Seller has the right to make temporary interruptions in access to the e-Shop in order to perform maintenance or upgrades, in addition to exchange, upgrade or configure hardware or software. Accordingly, no liability for any interruptions, resulting from the need to expand, change configurations, or replacement of equipment and software.

52. The Client is not allowed to use our e-Shop to store, host, transmit, send, use, publish or distribute any material which consist of or is linked to any malicious software.

53. No one is entitled to conduct any systematic or automated data collection activities on our e-Shop without our written consent.

54. Anyone is forbidden to use our e-Shop to transmit or send unsolicited commercial materials.
